Question 1

Can a foreigner legally own freehold land (Hak Milik) in Bali, Lombok, or Sumbawa?

Accepted Answer

No. Foreign nationals cannot legally hold Hak Milik (Freehold) titles in Indonesia. Expats and foreign investors must acquire property through Hak Sewa (Leasehold) or Hak Pakai (Right to Use) structures, often utilizing a PT PMA (Foreign Investment Company).

Question 2

What happens if an immigration agent submits forged documents for my Indonesian visa?

Accepted Answer

If Indonesian Immigration discovers forged documents in your file, the default outcome is a formal interrogation (BAP), deportation, and a permanent blacklist. You must immediately secure legal counsel to build a paper record that separates your actions from the agent's fraud.

Question 3

Do I need a lawyer for a villa lease agreement in Bali?

Accepted Answer

Yes. Standard broker templates often contain financial traps like vague extension clauses. Executing a Hak Sewa (Leasehold) contract through an in-house notary ensures complete document custody, clear enforcement clauses, and absolute title validity.
