IMMIGRATION ADVISORY DUE TO ESCALATING CONFLICT IN MIDDLE EAST FLIGHT CANCELED

Indonesia ITKT Emergency Stay Permit & Zero Overstay Fine Waiver – March 2026 Middle East Conflict Update for Bali & Nationwide

Legal Update for Foreign Nationals, Expats, and Tourists in Indonesia (March 2026)

The escalating Middle East conflict (including US-Israel actions against Iran) has caused widespread airspace closures in Qatar, UAE, Bahrain, and Iran. This has led to international flight cancellations and rerouting, severely disrupting travel to/from Indonesia—especially Gulf routes via Emirates, Etihad, and Qatar Airways.

As a result, many foreign visitors risk visa overstays in Bali and other areas if unable to depart before expiry. To prevent this, the Directorate General of Immigration (Ditjen Imigrasi) issued Circular Letter No. IMI-GR.01.01-133 dated March 1, 2026, implementing a special emergency policy nationwide, including at Kantor Imigrasi Kelas I Khusus TPI Ngurah Rai in Bali.

This force majeure relief helps stranded foreigners stay legally without penalties.

Key Emergency Measures: ITKT & Overstay Waiver

Izin Tinggal Keadaan Terpaksa (ITKT) – Emergency Stay Permit

  • Valid for up to 30 days (extendable case-by-case if disruptions persist).

  • Granted on a case-by-case basis with supporting proof.

  • Ensures legal stay while awaiting flight availability.

Zero Overstay Fine (Tarif Beban Rp 0)

  • No fines for overstays directly caused by flight cancellations/airspace issues.

  • Applies under Undang-Undang Nomor 6 Tahun 2011 tentang Keimigrasian, but only for qualified force majeure cases.

  • Overstays >60 days may still lead to deportation/blacklisting if not covered.

Eligibility Conditions To qualify:

  • Overstay must result solely from flight disruptions (not voluntary).

  • Provide proof: Written confirmation/declaration from the airline, Aviation Civil Authority, or airport authority.

  • Report immediately to the nearest Immigration Office or airport counter (before or soon after expiry).

Failure to report promptly may result in standard penalties.

How to Apply in Bali (Ngurah Rai Immigration Focus)

  • Visit Kantor Imigrasi Ngurah Rai (Jl. Raya Taman Jimbaran No.1, Badung) or the airport immigration counter at I Gusti Ngurah Rai International Airport.

  • Bring: Valid passport, airline cancellation letter, ticket proof.

  • Processing often same-day; Ngurah Rai has boosted staffing for quick service.

  • Monitor your visa expiry closely and act early.

Long-Term Alternatives: Visa Status Conversion Options If flights remain uncertain, consider converting to longer stays (subject to eligibility, sponsorship, and approval):

  • VOA/eVOA to Visit Stay Permit conversion (where permitted).

  • New Visit Visa application onshore (if eligible).

  • Limited Stay Permit (KITAS) for employment, family reunification, or investment.

  • Investor KITAS for PT PMA shareholders/directors.

Visa conversions depend on your current status, compliance history, and regulations—not automatic. Early assessment prevents future issues affecting KITAS, investor permits, or business in Indonesia.

Why Act Now? Immigration Compliance Matters Overstays impact future visa applications, KITAS renewals, and operations in Indonesia. Don't wait until your visa expires—seek clarification proactively.
